1. About these Terms
These Terms govern access to AdvertPlace, an online platform for listing and purchasing downloadable digital products, including software, source code, scripts, themes, plugins, templates and other permitted digital assets. AdvertPlace is operated by AT SCAN LTD (“AdvertPlace”, “we”, “us”). By creating an account or using the platform you agree to the relevant platform terms. A purchase may additionally be governed by the product licence and the seller’s clearly disclosed terms. Nothing in these Terms removes rights that cannot lawfully be excluded.
2. The role of AdvertPlace and the seller
Products may be offered by independent third-party sellers. The identity of the contractual seller for each transaction, and whether AdvertPlace is acting as intermediary or as the seller of record, must be clearly shown before the customer commits to pay. The checkout and invoice must correctly reflect the actual legal and payment arrangements; describing AdvertPlace as a mere intermediary does not, by itself, determine its legal responsibilities. Each seller is responsible for the accuracy of its listing, its rights to distribute the product and the obligations applicable to its sale. AdvertPlace remains responsible for its own platform services and for obligations imposed on it by law.
3. Accounts and eligibility
You must supply accurate registration information and keep your account secure. You must not impersonate others, misuse another account, circumvent access restrictions or make unauthorised transactions. We may request reasonable verification information where necessary for security, payment processing or legal compliance. We may limit accounts used for fraud or serious violations, giving notice where appropriate and lawful. We will not arbitrarily withhold money or statutory rights.
4. Product information and compatibility
Each listing should state its main characteristics, what is included, relevant technical and compatibility requirements, applicable licence, support terms and any known material limitations. Buyers should check these details before purchasing. Sellers must not use misleading descriptions, fake reviews or intellectual property they are not authorised to distribute. Where mandatory consumer information is missing or misleading, applicable legal remedies remain available.
5. Orders, prices and payment
Prices, applicable taxes, fees, currency and total amount payable must be displayed clearly before the order is placed. Additional charges may not be added without the customer’s express agreement. Available payment methods are shown at checkout and may change. An order is accepted and digital access provided in accordance with the checkout confirmation and applicable payment verification. Payment records and required contract confirmations will be supplied in a durable form, such as email, where required by law.
6. Digital delivery
Approved digital purchases are generally made accessible from My Purchases. Buyers should retain a lawful personal backup of purchased files and their receipt, subject to the licence. Temporary outages, compliance reviews and lawful removal of infringing products may affect availability. If paid digital content is not supplied as promised, buyers retain their legal remedies. We do not promise perpetual hosting or perpetual support unless the offer expressly includes them.
7. Licences and intellectual property
A purchase ordinarily grants only the licence expressly stated for the relevant product; ownership of copyright does not transfer unless explicitly agreed in writing. Permitted installations, client work, commercial use, modifications, sharing and resale depend on that licence. Buyers must respect third-party component and open-source licences. Sellers warrant that they have the necessary rights to offer their products and grant the advertised licences. Complaints regarding infringement may be sent to info@advertplace.net with the product link and supporting details.
8. Cancellation and consumer rights
Consumers buying online may have a statutory 14-day cancellation right, subject to legal exceptions. For digital content not supplied on a tangible medium, supply within the cancellation period requires the consumer’s prior express consent and acknowledgement that the statutory cancellation right will be lost once supply begins, with the required confirmation supplied on a durable medium. We will not treat a pre-ticked box or a general acceptance of these Terms as sufficient consent. If the statutory conditions have not been satisfied, the legal cancellation right is not lost merely because a file was made available.
Digital content supplied to consumers must comply with applicable requirements, including being of satisfactory quality, fit for any purpose made known in the legally relevant manner and as described. Applicable statutory remedies may include repair, replacement or a price reduction. No provision in these Terms excludes non-excludable rights under the Consumer Rights Act 2015 or other applicable law.
9. Refunds and disputes
A request for assistance or refund may be submitted through the support channel, with the order reference and description of the problem. We may ask for reasonable technical details and, where appropriate, liaise with the seller. Requests must be considered fairly and consistently with the buyer’s statutory rights, including where a download is faulty, materially misdescribed or not supplied. A discretionary goodwill refund is separate from a legally required remedy. Refunds, where due, should be processed by an appropriate method without imposing unlawful deductions. Users may raise applicable payment-provider disputes and enforce legal rights; these Terms do not prohibit either.
10. Seller membership and renewals
Buying products does not require a seller membership. Sellers may choose a paid membership plan to access seller functions. The price, duration, limits, material restrictions and renewal terms are displayed before payment. Adding money to the wallet does not in itself activate membership. An automatic renewal applies only when an appropriately authorised recurring arrangement is actually active; a saved preference alone is not proof of a charge authorisation. Sellers must have a clear way to review and disable renewal. Disabling renewal does not normally shorten an already paid period. Statutory and contractual cancellation rights continue to apply.
11. Seller verification, earnings and withdrawals
Seller identity and payout information may be reviewed manually to reduce fraud and meet applicable legal or payment requirements. Payment or approval of membership does not replace identity and payout verification. The platform must display applicable seller charges and relevant payout terms, including withdrawal methods, limits, fees, review procedures and any lawful holds, before those charges or conditions apply. Funds must not be withheld arbitrarily, and a seller may contest an error through support.
12. Acceptable use, reviews and security
You may not upload malicious code, spyware, stolen or unlawfully licensed material, deceptive listings, content violating third-party rights or products prohibited by law or applicable published rules. We may remove listings or restrict access where reasonably necessary for security, legal compliance or enforcement of these Terms, and provide a complaint route where appropriate. Reviews must reflect genuine experiences; fake or incentivised undisclosed reviews are prohibited. Do not disclose credentials or payment information to other users.
13. Platform availability, support and liability
We aim to provide a reliable service but cannot promise uninterrupted access. Item support and updates depend on the terms stated for the product and must not be implied where not offered. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that law does not permit us to exclude. Any further liability limitations must be reasonable, transparent and must not deprive consumers of mandatory remedies.
14. Privacy, cookies and records
Personal data is handled under the separately published Privacy Policy, and use of cookies and similar technologies is explained in the Cookie Policy. We may retain payment, account and transaction records where necessary to satisfy legal obligations, resolve disputes or prevent fraud. The legal basis and retention periods must be described accurately in the Privacy Policy.
15. Changes to terms and complaints
We may update these Terms for legitimate business, legal or security reasons. Material changes should be notified appropriately, and we will not retrospectively remove rights already acquired under an existing purchase. Complaints can be sent to info@advertplace.net or submitted through the website’s support system. We will consider them reasonably and explain available escalation routes where required.
16. Governing law
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protection rules and jurisdictional rights that apply where a consumer lives. Nothing in this clause removes a consumer’s right to rely on mandatory protections applicable in their home jurisdiction.
