1. About these Terms
These Terms govern AdvertPlace, an online platform where downloadable digital products such as software, source code, scripts, themes, plugins, and templates may be offered and purchased. AT SCAN LTD operates AdvertPlace (“we,” “us”). Creating an account or using the platform means accepting applicable platform rules. Individual purchases may also be subject to clearly disclosed product licenses and seller terms. Nothing here removes rights that cannot legally be excluded.
2. Platform and seller roles
Products may be offered by independent third-party sellers. Before an order becomes binding, the buyer must be told who the contractual seller is and whether AdvertPlace acts as an intermediary or the seller of record. Checkout and invoices must reflect the actual legal and payment arrangements. Merely calling AdvertPlace an intermediary does not determine its legal obligations. Sellers are responsible for listing accuracy, distribution rights, and obligations arising from their sales. AdvertPlace remains responsible for its own services and statutory duties.
3. Accounts and eligibility
Provide accurate registration information and safeguard account credentials. Impersonation, misuse of other accounts, bypassing security controls, and unauthorized transactions are prohibited. Reasonable verification may be required for security, payments, or compliance. Accounts involved in fraud or serious violations may be proportionately restricted, with notice when appropriate and lawful. Funds and statutory rights will not be arbitrarily withheld.
4. Product details and compatibility
Listings should describe essential features, included files, technical requirements, compatibility, licenses, support, and material restrictions. Buyers should review these before purchasing. Misleading descriptions, fake reviews, and distribution without authorization are prohibited. Missing or misleading legally required disclosures do not eliminate applicable consumer remedies.
5. Orders, pricing, and payments
Before an order is placed, the price, applicable taxes, fees, currency, and final total must be clear. Extra charges require express agreement. Available payment methods are displayed at checkout and may change. Order acceptance and digital access follow checkout confirmation and appropriate payment verification. Required contract and payment confirmations will be supplied on a durable medium, such as email, when the law requires it.
6. Digital delivery
Approved purchases are generally available in My Purchases. Buyers should keep their receipt and a lawful backup consistent with the license. Temporary outages, compliance reviews, or the lawful removal of infringing products may affect access. If paid digital content is not delivered as agreed, statutory remedies remain available. Permanent hosting or unlimited technical support is not promised unless expressly included in the offer.
7. Licensing and intellectual property
Purchases generally grant only the stated product license, not ownership of copyright unless expressly agreed in writing. Permitted installations, client projects, commercial use, modifications, sharing, and resale depend on that license. Buyers must respect third-party and open-source licenses. Sellers represent that they have the rights to sell their products and grant the advertised licenses. Reports of infringement can be sent to info@advertplace.net with a product link and supporting details.
8. Cancellation and consumer rights
Consumers buying online may have a statutory 14-day cancellation right, subject to exceptions. For digital content not supplied on a physical medium, delivery during the cancellation period requires prior express consent, acknowledgment that the statutory cancellation right will be lost once delivery begins, and the required confirmation on a durable medium. A prechecked box or general acceptance of these Terms is not sufficient. Where these statutory steps have not been met, making a file available alone does not extinguish cancellation rights.
Digital content must meet applicable standards, including satisfactory quality, conformity with its description, and suitability for a purpose communicated in the legally relevant manner. Remedies may include repair, replacement, or a price reduction. Nothing excludes non-waivable rights under the UK Consumer Rights Act 2015 or other applicable law.
9. Refunds and disputes
Contact support with the order reference and a description to request assistance or a refund. We may reasonably ask for technical details and, when appropriate, consult the seller. Requests are assessed fairly and consistently with statutory rights, including when a download is defective, materially misdescribed, or never delivered. A discretionary goodwill refund is separate from a legally required remedy. Refunds owed will be processed appropriately without unlawful deductions. Payment-provider dispute procedures and legal remedies remain available.
10. Seller memberships and renewals
Buying products does not require a paid seller membership. Sellers may select a membership plan to access selling functions. Prices, durations, limits, material restrictions, and renewal conditions are shown before payment. Funding a wallet alone does not activate membership. Automatic renewal requires an actually authorized recurring payment arrangement; a saved preference does not establish authorization. Sellers must be able to review and disable renewal. Disabling it normally does not shorten an already paid term. Statutory and contractual cancellation rights remain in effect.
11. Seller verification, earnings, and withdrawals
Seller identity and payout information may undergo manual review for fraud prevention and applicable legal or payment obligations. Buying or approving membership does not replace identity or payout-account verification. Applicable fees and payout conditions, including payment methods, limits, charges, reviews, and lawful holds, must be disclosed before they apply. Funds must not be arbitrarily withheld, and sellers may challenge errors through support.
12. Acceptable use, reviews, and security
Users may not upload malicious code, spyware, stolen or improperly licensed materials, deceptive listings, content infringing others' rights, or products prohibited by law or published rules. Listings may be removed and access proportionately restricted for security, legal compliance, or enforcement, with an appropriate complaint route where applicable. Reviews must reflect real experiences; fake or undisclosed incentivized reviews are prohibited. Do not share passwords or payment credentials with other users.
13. Availability, support, and liability
We aim to operate a reliable platform but cannot promise uninterrupted service. Product updates and support depend on the stated terms of the specific listing. Nothing limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. Any other limitation must be reasonable and transparent and must preserve mandatory consumer remedies.
14. Privacy, cookies, and records
Personal data is handled under the separate Privacy Policy, and cookies and similar technologies are described in the Cookie Policy. Account, payment, and transaction records may be retained as needed for legal duties, disputes, or fraud prevention. Accurate legal grounds and retention periods must be explained in the Privacy Policy.
15. Updates and complaints
We may revise these Terms for legitimate business, legal, or security reasons. Material revisions will be communicated as appropriate and will not retroactively remove rights obtained under previous purchases. Complaints may be submitted through support or sent to info@advertplace.net. They will be reviewed reasonably, with further resolution routes explained where legally required.
16. Governing law
These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections and applicable jurisdictional rights where a consumer lives. Consumers retain any mandatory protections provided by the law of their country of habitual residence.
